Divorce in two countries is double the trouble

(Reuters) - Think divorce in the United States is hard? Try ending your marriage in two countries at once.

Red tape, financial obstructions and cultural differences are just a few of the added problems faced by a divorcing American who is a dual citizen, living abroad or married to a citizen of another country.

There are no statistics on how many Americans deal with divorce and dual citizenship, but it is a growing trend due to custody issues, says Ken Altshuler, president of the American Academy of Matrimonial Lawyers.

"We're seeing more parental kidnappings, more conflict, more litigation and simply more to fight about," says Altshuler. "Back in, say, 1975, or even in the 1980s, if a woman wanted to move her kid to Brazil, she would have, and nobody would have challenged that because the man was not going to win."

Robert Makielski of Culpeper, Virginia, hopes that is no longer the case as he fights for custody of his two children. Gabriel, 5, and Isabel, 10, are living in the Dominican Republic with his ex-wife, a citizen of that country.

"I'm basically dealing with a corrupt system in a foreign court," says Makielski, 52.

So far, he has spent $50,000 on his travails, and he figures he will spend plenty more. "I expect to probably lose everything," he says.

Makielski's case is extreme, of course, but any dual citizen - or anyone married to a dual citizen - in the midst of a divorce is going to find themselves facing a host of problems.

LOCATION, LOCATION, LOCATION

The first question to consider is: Where is it going to be easiest for you to divorce?

Just because you or your spouse is American, do not assume that you can file for a U.S. divorce, especially if you live abroad.

"It doesn't matter where you were born, it's where you live that's going to determine which court has the jurisdiction," says New York matrimonial lawyer Marilyn Chinitz.

That is not always a bad situation. Emily Edwards, 30, a British and American citizen, married and lived with her husband for two years in London. They then moved to Cambridge, Massachusetts, but soon decided they were not compatible, and they divorced there in 2010.

Because the couple had no children or joint property, "for us, it was easy," says Edwards, who teaches English as a second language to adults at a private school.

But the laws and outcomes can vary greatly from country to country. As a general rule, divorce and dual citizen issues are easier to manage in the United States and Europe. Laws that greatly favor men's rights over women's make navigating a divorce in the Middle East and North Africa especially challenging.

And if you and your spouse disagree about which country is best to divorce in, it becomes a race. Whoever files the fastest determines where the divorce will proceed.

WHAT HAPPENS TO THE KIDS

If you have young children, location could be especially important. Think Sally Field in the movie "Not Without My Daughter," the real-life story of Betty Mahmoody, an American mother who struggled to escape from Iran with her daughter. )

"It can be a very anxiety-ridden situation when you have this type of multiple citizenship and children who are moved from location to location," says New York matrimonial lawyer Malcolm Taub. "It makes it a much more complicated proceeding even under the best of circumstances."

The international community has tried to streamline the judicial process when it comes to divorcing across borders, primarily through the Hague Conference on Private International Law, which has about 75 countries as members.

Still, that does not make it any less complicated for some parents, particularly those living outside of their home turf. Chinitz gives the example of an American married to a Swede who decides to move from New York to Stockholm with their 3-year-old. Five years later, the American parent wants to divorce and take the child back home. The other spouse says no way.

"The American parent is going to be in trouble, because she should have consulted international counsel before making the move," Chinitz says.

But what should you do in a situation where you think your child has been abducted by the other parent? You should ask the state department or your local government representatives to intervene, but you should keep your expectations in check.

"They can get the dialogue going and can put you in touch with key people at the American embassy, but if a country's going to say our citizen has custody, and take their side, there's not much they can do," Altshuler says.

Given his ordeal, Makielski has these words of advice: "Don't get your kids passports."

DIVISION OF PROPERTY

Many divorcing couples who hold dual citizenship find themselves splitting up property around the globe. Similar to how it works with children, the court deciding the case has the power to award property - even property in another country - to one spouse or the other.

If a spouse is overseas with the property and refuses to give it up, you end up having to hope for the best or to show up on the doorstep abroad and try to work it out.

Malcolm Taub has a client whose husband left the country and let his visa expire, which means he cannot return to get the divorce his wife is demanding. If she wants a divorce and child support - and she does - she will have to travel to get it.

"She will have to pursue him in a court in his country of origin," Taub says. "There are so many twists and turns in these types of situations that it's impossible to predict how they will play out."

Obama aggressive in foreign policy debate with Romney

BOCA RATON, Florida (Reuters) - President Barack Obama repeatedly attacked Republican challenger Mitt Romney on foreign policy on Monday in their third and final debate in an effort to blunt his opponent's surge in the polls with two weeks left until Election Day.

The high-stakes debate strayed frequently into domestic policy, with Romney seeking to bolster his argument that Obama had bungled the U.S. economic recovery with high unemployment and rising debt.

Neither man threw a knockout punch or made a noticeable gaffe in the 90-minute encounter at Lynn University in Boca Raton, although Obama scored enough debating points to be declared the winner in the first surveys.

A CBS News snap poll declared 53 percent believed Obama won, versus 23 percent for Romney and 24 percent saying it was a draw. A CNN poll put Obama as the winner by 48 percent to 40 percent.

With foreign policy a low priority in a campaign focused mostly on the economy, it was unclear what impact the debate would have on the race, which enters the final frenzy of campaigning with both men tied in the polls before the November 6 election.

Respondents in the CNN poll were split over whether the debate would influence their votes.

The debate was one last chance for the candidates to appeal to millions of voters watching on television and Obama was the aggressor from start to finish.

'HORSES AND BAYONETS'

He criticized the Republican for lacking ideas on the Middle East, mocked his calls for more ships in the U.S. military and accused Romney of wanting to bring the United States back to a long-abandoned Cold War stance.

Obama had a biting, perhaps condescending, response when Romney said the U.S. Navy had fewer ships now than at any time since 1917.

"Governor, we also have fewer horses and bayonets," Obama said, suggesting that Romney's worldview was obsolete. "We have these things called aircraft carriers, where planes land on them. We have these ships that go underwater, nuclear submarines."

Obama also said the Republican presidential candidate was seeking to turn back the clock by once declaring Russia the top "geopolitical foe" of the United States.

Seated at a table with moderator Bob Schieffer, Obama said Romney was trying to return U.S. foreign policy to the 1980s and that the decade was "now calling to ask for their foreign policy back because, you know, the Cold War's been over for 20 years."

Romney said Obama's policies toward the Middle East and North Africa were not stopping a resurgence of the threat from al Qaeda in the region.

"Attacking me is not an agenda," said Romney. "Attacking me is not how we deal with the challenges of the Middle East."

Romney, wanting to make no mistakes that could blunt his recent rise in the polls, did not take the bait on some occasions when attacked, which may have led viewers to declare Obama the winner.

Although Romney lacks foreign policy experience, his aides said they believed their man's performance allowed him to pass the "commander-in-chief" test to show Americans he is knowledgeable about foreign affairs and enable them to envision him in the Oval Office.

Romney accused Obama of failing ally Israel, which the Democrat has not visited since taking office four years ago.

The former Massachusetts governor, whose central theme throughout the campaign has been a promise to rebuild the weak U.S. economy, frequently turned the discussion back to economic matters, saying U.S. national security depended on a strong economy.

"The president hasn't balanced a budget yet. I expect to have the opportunity to do so myself," said Romney.

Dom Quinto, Sr., who coached Masuk to its first football state championship games in 1985 and 1986, died Thursday. He was 83.

Before he established Masuk football?s tradition in the 1980s, Quinto was a pioneer of the town?s sports tradition. He began the Monroe Lions Pop Warner program in 1966, and guided the 7-8 grade teams to five consecutive unbeaten seasons and Candlewood Valley League titles. He also took the 1978 team to the Walt Disney World Bowl. Quinto also served as the CVL President.

The football field at Wolfe Park is dedicated to him.

He started as an assistant coach at Masuk in 1979 and took over as coach in 1984. Masuk was 1-9 his first year, but in the second Masuk won nine straight games and played in the Class MM championship vs. Hillhouse. Masuk lost 16-6.

The next season Masuk again reached the MM title game, losing to East Catholic 42-3.

Quinto was a man about town. He was one of the original owners of the Monroe Sports Center and the first maintenance superintendent of the Town of Monroe?s Parks and Recreation. He started the town?s first youth recreation basketball league and served as its director for 23 years. Quinto also began the town?s recreation girls softball league and served as its director. He was Masuk?s softball coach in 1989 and 1990.

BOSTON (CBS) ? Paying for college is not only a problem for recent grads. Those big bills are staying with families for decades and it could wind up costing some their retirement.

?This is the most worried I?ve ever been, because of the college,? says Robin Curley of Milton. Robin and her husband, Ted, are looking at triple the trouble when it comes to paying off student loans. Their 19-year-old triplets all just started their freshman years at college. Derek is at UMass Amherst, Samantha is at the University of Tampa, and Justin is going to UNH.

When they graduate college in four years the Milton siblings each expect to have racked up at least $30,000 in debt. That?s on top of the $240,000 their parents plan to borrow.

?We don?t have a plan. How can I have a plan how to pay off $240,000? I still have a mortgage on this home,? says Robin. The Curleys are also unsure if they will ever be able to retire. And there?s reason to be concerned: of the $1 trillion in student loan debt here in the US, 40% is owed by people over 40.

At 62-years-old, Hazel Robinson, is also facing a mountain of debt: $109,000. Hazel found her calling later in life and earned her masters in social work only five years ago. She now counsels clients at the Pine Street Inn. It?s priceless work without a big paycheck. And while Hazel is happy to keep working well into her senior years, she is worried these student loans could cut into her Social Security. Thousands of checks are being garnished every year to help repay federal loans.

At American Student Assistance Mike Ryan works out repayment plans for struggling students at any age. ?It?s not uncommon now for folks to still be managing that 25 or 30 years after the debt was incurred,? says Ryan. But, that time frame doesn?t work for anyone nearing retirement.

Family of six homeless after house fire | Top Video | KIMA CBS 29 ...

YAKIMA, Wash. -- A family of six is left homeless after fire destroyed its house.

The quick moving fire ripped through the house on Rockford Road around noon Thursday.

Syrilda Welch was at work when she got the call Thursday afternoon about her house.

"That the house was on fire and it's gone," Syrilda said.

Syrilda rushed home to find it in flames. Her family of six lives at the home, including her elderly father, long-time boyfriend, two children and an infant.

Investigators are looking into what started the fire. The family tells Action News it's possible someone else was at the house and could be responsible.

Crews were quick to the scene, but say it was too late to save the structure.

"It appears that fire had gotten its start and moved rather quickly before it was noticed," said East Valley Fire Acting Chief Michael Riel.

Leonard Kimbel is Syrilda's boyfriend. He says the fire comes during a rough time for the family.

"We moved in here a year ago to help her mom that was dying and now we're here to take care of her dad," Leonard said.

Family and friends showed up to the comfort the family that might have lose everything.

"I don't believe there's any insurance, I'm hoping we can figure out how we're gonna do it. You know, we'll struggle. Both of us work hard and we'll keep going from there," Leonard said.

"It's just devastation I guess. Starting over," Syrilda said.

A family grateful to be alive, but forced to start over with next to nothing.

MILAN, Italy (Reuters) - Italy's passion for eating is world famous but more than half of Italians are now recycling food leftovers to prepare new meals as they try to save money and weather a year-long recession, a survey showed on Friday.

The survey, by food-producing association Coldiretti, said 59 percent of Italians were re-using pasta, bread and vegetables to try to make ends meet, a trend that underlines how austerity measures and unemployment are hitting people's wallets.

Italy wasted 10 million tonnes of food each year worth around 11 billion euros ($14.40 billion), the survey said.

But the research, conducted with statistical group SWG and called "Italians' behavior at a time of crisis", suggested Italians could make a virtue of necessity.

"Anti-waste recipes are numerous in Italy," Sergio Marini, the chairman of Coldiretti, said at the presentation of the report.

"You only need a little creativity and you can cook tasty meatballs with leftover ground beef, eggs, bread and cheese," Marini said.

Although Italy is a country of rich culinary traditions most of them are based on poor ingredients as they date back to the end of World War Two, when food was scarce.

The Tuscan "ribollita", the Venetian "pinza" or the Neapolitan "frittata of pasta" sound like gourmet meals but all are based on recycled ingredients such as pasta and vegetables.

Consumer spending is headed for its biggest post-World War Two decline this year and data from ISTAT shows consumer morale has only recovered slightly from a historic low hit in June, retail lobby Confcommercio said last month.

Coldiretti said one in four Italian families was in a difficult economic position, 3 percent more than last year.

A planned one-percentage-point hike in value added tax, due to come into effect in July next year, could cost families a further 500 million euros in higher prices, Coldiretti said.

Waterford Graded district budget nears completion

As a prelude to the district?s upcoming annual meeting, members of the Waterford Graded School Board?s Personnel, Finance and Negotiations Committee this week discussed the proposed 2012-13 budget and property tax levy.

Superintendent Chris Joch presented the committee with the most up-to-date details of the $17.5 million budget, which could still be refined in the next week.

Plans call for increasing the property tax levy ? one of the district?s largest sources of income ? by 2 percent. In the past three years, the district has maintained a status-quo approach by not raising the levy.

Overall, Joch said he anticipates a 2.6 percent increase in revenue in Fund 10 ? the district?s general operating budget that funds most of the daily costs that keep all four schools functioning throughout the year.

During this year?s budget-building process, Joch and other district administrators have anticipated a rise in expenses by an estimated 4.1 percent.

?The increase ? is due to special education programming costs, health reimbursement start-up costs, debt service obligations and unemployment insurance costs,? Joch said.

Like all districts across the state, Waterford Graded is awaiting word on the specific amount of state aid, which is another significant source of income for the district.

The Wisconsin Department of Public Instruction plans to notify districts of the specific award amount by next Monday, Oct. 15.

Depending upon the amount, Waterford Graded officials could make slight modifications to the budget.

Officials do anticipate a drop in state aid because of the declining enrollment trends in recent years. But Joch pointed to a number of cost-cutting measures that have helped shore up some of the losses, including staff reductions and reviewing a number of contracts, including one for busing.

Moving forward, Joch said strides will have to be taken to find ways of generating income beyond the levy and state assistance.

The issue is to be discussed at the annual meeting scheduled at 7 p.m. on Monday, Oct. 22, in the Evergreen Elementary School cafeteria, 817 W. Main St.

?We have to find other alternate sources of revenue, other than property taxes and state aid,? he said.

There have been changes to the district?s lunch program, for instance, to ensure it is at a break-even point. Revenue from lunches cannot fund other district programs, but dollars elsewhere in the overall budget are needed if the program is not self-sufficient.

The district?s presentation at the upcoming annual meeting will delve into a number of topics, including an analysis of what the mill rate and cost per pupil is in Waterford Graded, compared to other districts.
